Terms and Conditions

1. These terms and conditions apply to the KingFisher Premium Packaged Drinking Water Contest for consumers (hereinafter referred to as "Contest") sponsored and launched by United Breweries Limited (‘UBL’) through Premier Sales Promotions Pvt. Ltd. (‘Agency’). which shall be the primary implementation partner for the Contest.

2. Consumers participating or seeking to participate in the Contest shall individually be referred to as "Participant" and collectively as "Participants", who under no circumstance shall be represented by anyone else on their behalf at any point during this Contest. Reference to Winner in in T&C shall be applicable to any participant who has received any communication/ acknowledgement of having won any Reward under the Contest.

3. By participating in the Contest as provided hereunder, Participants shall stand a chance to win digital voucher Or Match Tickets Or Meet & Greet with Cricket Player(s) (together ‘Rewards’).

4. Consumers of UBL’s Products may participate by scanning the QR Code or by visiting the website on www.kingfisherexperience.com.

Eligibility:

1. This Contest is open for participation only to persons who fulfils all of three following conditions: (i) Person should be a permanent resident of India (ii) Person is above the legal drinking age in their respective state of residence at the time of Participation and(iii)Person is legally competent to contract.

2. Employees, their immediate family members, agents, distributors, retailers and any other channel partner of UBL and Agency are not eligible to participate in this Contest.

3. UBL reserves the right to cancel participation and to withhold Rewards, if any won, from in-eligible Participants. UBL reserves the right to exclude any person from the contest, at its discretion, without assigning any reasons.

Contest Period & Contest Timings:

1. This a limited time Contest that will be available on Products sold from 12:00:01 AM on 24/04/2024 until 11:59:59 PM on 29/05/2024 or until stocks last (whichever is earlier).(“Contest Period’)

2. All Participants are required to make full and correct entry on the website before 11:59:59 PM on 29/05/2024. Entries made after the Contest Period or invalid entries (i.e., multiple entries, incorrect details, non-completion of the game, incorrect unique code, etc.) will not be considered

3. Time of participation will be determined as the time at which the entry is successfully registered on the website.

4. Participants will be chosen between 12:00:01 AM to 11:59:59 PM during the Contest Period and they will stand chance to win various rewards. Participants will be chosen through a computerized, scientific random selection by UBL, or the Agency appointed by UBL.

How to Participate:

1. Participants shall register themselves for the Contest by entering their registered mobile number and the on the www.kingfisherexperience.com , by scanning the QR Code or entering the website address on the browser.

1. The digital reward winners shall be selected on the basis of the unique mobile number and unique Email ID on a computerised random basis.

2. The participants who have landed on Match Tickets Or Meet & Greet by spinning the wheel will be required to answer a simple question. The winners will be declared basis the uniqueness and freshness or the answer by UBL or it’s agency.

2. Upon successful completion of registration, Participants:

1. can virtually Spin the wheel

2. and stand a chance to win digital rewards.

3. will be enrolled for a lucky draw to win the Final reward “Match Tickets Or Meet & Greet” (Mega Reward).

4. Any participant who has won a digital reward will not be eligible to win any further rewards (i.e Match Ticket Reward or Meet & Greet Reward) .

Selection of winners for Digital Reward:

1. The A draw through random computerized selection will be conducted during the Contest Period to select the winners for the digital rewards.

2. The winners will receive their digital reward via SMS on their winning mobile number within 24 business hours

3. The participants who have landed on Match Tickets Or Meet & Greet by spinning the wheel will be required to answer a simple question. The winners will be declared basis the uniqueness and freshness or the answer by UBL or it’s agency.

4. Match Ticket Reward or Meet & Greet Reward will be issued subject to the winner satisfying the verification process and documentation requirement of UBL.

5. UBL reserves the right to forfeit the Match Ticket Reward or Meet & Greet Reward in the event that the winner does not fulfil the verification and documentation process in the time and manner stipulated by UBL.

Rewards:

1. Any unused voucher after contest period is non- renewable, non-transferable, non-refundable and non-redeemable.

2. Rewards won, if any cannot be exchanged, transferred, or redeemed for cash or any other benefit.

3. The image of the merchandise depicted on the press ads/posters/TVC's/pack shots etc. are for illustrative purposes only and the actual merchandise may vary from the depiction or claims made.

4. The merchandise cannot be exchanged, non –transferable, non-assignable cannot be.

5. For any Participant who has won Match Ticket Reward or Meet & Greet Reward, UBL shall be sponsoring only the entry ticket on a pre-defined date and match.

6. All and any additional expenses including, but not limited to travel to and from departure cities, food and beverages, local commute, visa, medical, insurance, personal expenses of any nature shall be excluded and be borne by the Participant.

7. Participant shall be personally responsible for fulfilling necessary procedures for arranging necessary financial resources to undertake the trip and for their personal safety and security during the Trip.

8. No claims shall be entertained for accept any request for alteration/addition/extension/modification in personal details, dates, accommodation or travel facilities, seats, venues, matches, etc.

9. UBL or Agency shall have no liability in case the Participant is unable to undertake the trip for any reasons whatsoever or to make good of any losses occurred to Participant due to any inability to undertake the trip.

Contacting Winners:

1. If any Participant has won any Match Ticket Reward or Meet & Greet Reward, the Agency appointed by UBL may contact the Participant and inform them of the terms and manner in which they are eligible to claim their Reward. Rewards shall be offered only to Participants who fulfil the eligibility criteria and complete the verification process within the time stipulated by UBL.

2. For Match Ticket Reward or Meet & Greet Reward: The Agency may contact the participant on their winning mobile number. In the event, the shortlisted winner's number is busy, unreachable, or he/she does not attend the call, two (2) more attempts will be made to reach the Participant. If even on the third attempt, the Participant does not attend the call or is unreachable, the Participant's participation in the contest comes to an end and the Participant's entry stands cancelled and Participant becomes ineligible to receive the prize.

3. Participation Module : In case of a positive response from the shortlisted winner, each such shortlisted winner will be required to confirm age, identity and address over the phone on a recorded line and send the following documents and collateral:

4. For gifts above Rs. 10,000/- (Ten Thousand) PAN card & Aadhar card copy is mandatory. TDS will have to be paid by the winner upon filing of income tax return

5. The Participant is requiring to complete Participation Module and send them to designated email id within 2 business days, failing which the participation shall be cancelled. UBL or Agency shall not be responsible for any non-delivery, technical errors in receiving Participation Module. The responsibility of ensuring that the Participation Module reaches the address as duly prescribed in the Contest lies solely with the Participant.

6. Upon receipt of the Participation Module, UBL or its Agency shall scrutinize all the documents so received. If all the documents and the wrapper submitted are in order and valid then the respective participants will be intimated as Winners.

7. No Reward will be awarded if the information presented by the Participant(s) at the time of entering the contest is incorrect/incomplete/found inaccurate upon due diligence.

8. The cost and expenses of postage of Merchandise and other documentation shall be borne by the Participant and the Agency shall not be responsible for any accident or mishap or loss of the merchandise or documentation transit.

9. No justification/explanation for non-receipt of the Participation Module or any missing documents shall be accepted.

10. In the event of the death of the confirmed winner, no claim from the nominee or his/her legal heirs of the confirmed winner shall be entertained for receiving the prize.

11. UBL and the Agency disclaim any accuracy or perfection of the Contest and shall take no responsibility for the safety or negligence of Participants while entering or participating in the Contest

12. UBL or its Agency will not be responsible for any NDNC (National Do Not Call) Registry regulation that will come into play. All Participants agree that even if they are registered under National Do Not Call registry by the Telecom Regulatory Authority of India (TRAI) or their respective service provider’s Do Not Disturb list, UBL will have all the authority to call such shortlisted Participants by virtue of them having voluntarily participated in the Contest.

General Terms & Conditions:

1. Rewards are subject to the appropriate tax rules as applicable. All tax liability on the Rewards shall be borne by the Participant, without recourse to UBL or Agency.

2. All rewards are provided on an "as-is basis" and without any warranty or guarantee concerning the quality, suitability or comfort.

3. UBL and/or its associates, affiliates and/ or its management, directors, officers, agents, representatives shall not be responsible for or liable (including but not limited to the product and service liabilities) for deficiency and/ or defect of any merchandise/service and/or for any kind of consequential damages/ loss, in any manner whatsoever. Participant hereby releases Company against any and all loss claim, demand, expense, liability or damage arising from or in connection with the rewards.

4. UBL reserves the right to modify eligibility criteria, duration of Contest, terms & conditions including rewards, of the Contest at its absolute discretion. UBL at any time can suspend, withdraw, or discontinue the Contest or restrict participation of any person, with immediate effect and without assigning any reason or notice.

5. All decisions of UBL in respect of the Contest and the Rewards, including selection of Winners etc., made at its sole discretion, shall be final and binding on the Participant. UBL/Agency shall not entertain any correspondence or any other claims whatsoever, in this regard.

6. Each Participant represents and warrants that he/she is legally competent to enter into binding contracts under applicable laws. By taking part and/or entering into the Contest, the Participant warrants that all information provided by the Participant regarding Participant's name, age, state, city, address, phone number, etc., is true, correct, accurate and complete.

7. None of the provisions of these Terms and Conditions shall be deemed to constitute a partnership or agency between any Participant and UBL and the Participant shall not have the authority to bind UBL in any manner whatsoever.

8. UBL or its Agency shall not be liable to perform any of its/their respective obligations under the Contest where they are unable to do so as a result of circumstances beyond their control any unforeseen event, etc, and shall not be liable to compensate the Participant in these circumstances.

9. Failure to exercise or delay in exercising a right or remedy provided hereunder or by law does not constitute a waiver of the right or remedy or waiver of other rights or remedies on the part of UBL or its Agency.

10. UBL or its agency accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, disruption of internet connectivity, unique codes, documents, claims or correspondence whether due to error, omission, alteration, tampering, unauthorized data hacking, deletion, theft, destruction, virus attack, transmission interruption, communications failure, hardware failure or otherwise. UBL or its agents shall not be liable for any consequences of user error including (without limitation) costs incurred.

11. If a Participant is dissatisfied with the Contest or the Contest rules and/or any content or any requirements of the Contest form, the materials available related thereto, or with these terms and conditions, his/her sole and exclusive remedy is to not participate in the Contest.

12. If a person chooses to access the Contest Website from outside India, he/she shall do so on his/her own initiative and shall be responsible for compliance with applicable local laws of the country.

13. The participation in the Contest is purely voluntary and the same shall be construed as an acceptance of the terms and conditions stipulated herein.

14. Participant consents to UBL or the Agency to collect and process their personal data. Such data shall be stored and used for the purpose of this Contest and to inform Participant of future contests of similar nature, unless Participant expressly choose to opt out of such communications.

15. The Contest is subject to the guidelines/directions issued by the Competent Authority having jurisdiction on the subject matter from time to time.

16. Participation in the Contest does not imply any acceptance to any offer contained herein and the same shall be subject to the Participant satisfying the Terms and Conditions contained herein and pending other preliminary verification/due diligence done by UBL

17. The contest is being administered and conducted by the Agency.
